» Militia means you and me

Ms. Kinnaird’s fantasy vaguely refers to an 1875 Supreme Court case wherein she alleges “that the Second Amendment applies to the government, not an individual gun owner.” A closer reading of the 1875 Supreme Court case United States v Cruikshank affirms what Americans have long known: that the right to keep and bear arms is a fundamental right neither granted nor revocable by the government. To wit: “The right to bear arms is not granted by the Constitution; neither is it in any manner dependent upon that instrument for its existence.”

The Second Amendment does not specify the organized militia, the national guard, the state forces or even the reserve militia. Instead, the second amendment broadly referred to the militia, whose definition is found in the text of the Militia Act of 1903 thus: “the militia shall consist of every able-bodied male citizen … who is more than eighteen and less than forty-five years of age.” So even if the Second Amendment was intended to be a collective right, it would still appear to apply to the majority of our adult citizenry.

Armed with information and historical context, Ms. Kinnaird may better understand why Americans rightly revere the Second Amendment as sacrosanct. And why the vast majority of Americans are absolutely unwilling to give up that individual right.

– Ingenious if you think about it. I don’t know if it will stick, but totally misusing the term three percenters in such a way is positively Orwellian and would be loudly applauded by Alinski and his ilk. Not having any goals means that there can never be any failure on the part of the bureaucrat

– They want to take that name and turn it into a synonym for criminal. They have an agenda and someone else orchestrated that.

Obama either knows better or actually believes that there is no such thing as evil except as created by society. He is a liar, but in purveying his lie, he managed to lump mentally ill people, most of whom are peaceable, loving folk, into the same category as mass killers.

As a reminder to all those who were in the sandbox doing the bidding of the country, do not ever allow yourself to be diagnosed as PTSD. And this goes for any reader anywhere, not just Soldiers and Marines. Do not be lumped into the category of mentally ill. You’ll never get off the list.

But in spite of his stupid insult to the mentally ill, there is (in the words of C. S. Lewis), a deeper magic that we who are watchers and learners know. The witch Obama couldn’t care less about mass shootings, or crime in Chicago, or anything of the sort. He wants to confiscate guns because he is a totalitarian. Totalitarians must destroy the will and ability to resist.

But now the Bergdahl deal is polling poorly. So, you know, things change.

For now we are self-destructing. The elementary purpose of war is to destroy the other side’s ability and will to make war upon you. Destroying our ability to make war is still beyond them, but they have done a fine job of destroying our will, aided and abetted by their paid public relations firms, by the ACLU, the New York Times, the Democratic Party and yes, the Republican Party.

And now for the money quote …

The message that we sent is that attacking us is going to be inconvenient for them, when the message that we should have sent was that it was futile. That was the message we could have sent if all they had seen of us were smoke plumes and sudden death. Instead of allowing them to see soldiers traipsing around, choppers evacuating our wounded and realizing that we bleed just as easily as they do.

We can cut off the head of the snake or we can shake a stick at it, or learning to wear heavy boots. So far we’ve shaken our sticks loudly and impotently and we wear heavy boots and take them off at the airport. That’s the game we’re playing and it’s a loser’s game.

To defeat the enemy, we have to defeat the enemy. And that means destroying his wealth, his backers, his intellectual leaders and the energy source that provides the momentum for the conflict.

Nine public-school students sued the state for sticking them with crappy teachers, who, under California law, are eligible for lifetime tenure after just 18 months in the classroom.

… Whose rights trump? The teachers’ rights not to be fired without due process, as due process is defined under the tenure law, or the students’ rights to an education of the same basic quality as all public-school students are supposed to have?

The right to an equal education stems from California’s state constitution, not the U.S. Constitution, in case you’re wondering whether this decision might make its way up the food chain to the Supremes.

This is what happens when you go fooling around with rights creation. It’s a lesson that, sadly, most Americans never learn.
The lesson is this: Rights are rights. Rights pre-exist written law. Rights will survive written law. Rights cannot be created by written law, no more than written law can alter the laws of physics.

There is no right to a job, much less a right to tenure. There is no right to crappy education, quality education or anything in between.

Rights do not collide or conflict.
But the silly conceptual stuff that lawmakers call rights most always collide and conflict.
