If I knew what to think and say about yesterday’s Court decisions, I still wouldn’t know how to say it. So I will resort to my usual practice of finding words written by others that seem to relay my intuitions.

» Liberty fights back: The silver linings in the Obamacare ruling

Today’s ruling on the Patient Protection and Affordable Care Act (a.k.a. Obamacare) was, when looking at the intent of the Framers of our Constitution, a bad, bad thing. As much as we would like to believe such things are not possible, they are. The Supreme Court has gotten many things wrong throughout American history—sometimes, spectacularly wrong. But in the long march of history, today’s decision may be exactly what we needed. Don’t get me wrong—on the merits themselves, this decision is certainly not what we had hoped. However, there are a number of silver linings here, both in the decision itself and in the ramifications it will have.

…..“We cannot comfort ourselves with a 5-4 or even a 6-3 split. We must make it so that Kagan and Sotomayor are the only liberal-activist Justices left on the court. Obama CANNOT be allowed to make any more appointments.” If that point was not crystal clear to Republicans, conservatives, and libertarians before, it is now.

…. Obamacare is now a tax. It is no longer a health care law. It is a tax. It is, and will henceforward be called by all its detractors, THE OBAMACARE TAX …. A majority hated the individual mandate before it was a tax. Now that it is officially a tax, they’re not going to suddenly fall madly in love with it. Chief Justice Roberts may have just rung the Democrats’ death knell.

…. While many feel betrayed by Roberts’ decision to agree with the argument that the individual mandate is a tax, he took entirely the right position in stating that the mandate is not constitutional under the Commerce Clause. In the long run, that decision may avail us far more. In the many decades since the infamous Wickard vs. Filburn decision, Congress’ power to regulate our lives has steadily expanded under the aegis of the Commerce Clause. This decision may be the high water mark of expansive Commerce Clause jurisprudence, and the moment when that tide begins to ebb.

….Remember, big bad things—as bad as they are—are sometimes necessary to bring about big good things. Liberty always fights back, and this fight is just getting started.

» I’m Not Down on John Roberts

Republicans have punted a number of issues to the Supreme Court asking the Court to save us from ourselves. They can’t do that with Roberts. They tried with McCain-Feingold, which was originally upheld. This case is a timely reminder to the GOP that five votes are not a sure thing.
With John Roberts’ opinion, the repeal fight takes place on GOP turf, not Democrat turf. The all or nothing repeal has always been better ground for the GOP and now John Roberts has forced everyone onto that ground. Oh, and as I mentioned earlier, because John Roberts concluded it was a tax, the Democrats cannot filibuster its repeal because of the same reconciliation procedure the Democrats used to pass it.


By persuading the court to reject a Commerce Clause rationale for a president’s signature act, the conservative legal insurgency against Obamacare has won a huge victory for the long haul. This victory will help revive a venerable tradition of America’s political culture, that of viewing congressional actions with a skeptical constitutional squint, searching for congruence with the Constitution’s architecture of enumerated powers.

Now, the lesson I think I have learned, I put into analogy:
Americans who fought the birth of the Obamacare monster had hoped to take a rest from that battle. We thought we had sent five heavily armed warriors to finally kill it, burn it and bury it. We were prepared to move on to other matters. At least one of those five has decided that simply killing this monster without disabling it’s parent would be, at best, only a temporary reprieve. Better to cut the food supply of the parent to hopefully prevent future monster spawn – and leave the current monster to be dispatched by those whose responsibility it is and has been from the beginning – We, the People.

The parent monster is the socialist progressives. The food supply is the long-abused Commerce Clause.

Print more race cards! Stat!

At a Tuesday press conference in Washington, D.C., human shield Al Sharpton condemned the upcoming House vote on a contempt motion against Holder as “reckless” and “morally reprehensible.” Yes, the infamous hate-crimes hoaxer, cop-basher and riot incitement specialist is now the self-appointed sheriff of Capitol Hill morality. A Huffington Post report hyping Sharpton’s protection racket decried the contempt citation as an “assault on minority rights.” In typical race-baiting style, Sharpton told the leftwing website: “I’m not saying that this is because Holder is black, and I’m not calling (Republicans) racists. I’m saying what they’re doing has a racial effect.”

I suspect that Natasha has learned very little from a harsh lesson:

Before a journalist goes to a place to report complex social phenomena he or she should make him/herself knowledgeable about the culture of that place. The place visited by ms. Smith has been under the shadow of a criminal for 14 centuries.
