Obamacare, Supreme Court Ruling

For the first time, as far as I can remember, I find myself in disagreement with Rush Limbaugh, Glenn Beck, Mark Levin and many other conservatives for whom I have much respect. It’s a weird feeling.
So far, I still cannot condemn Justice Roberts. While others are calling him a traitor and a coward, and knowing that the whole story has yet to be told, my gut tells me to wait and see. I am a checkers player watching a chess match; of which I know just enough to know that I don’t know enough to criticize the moves made by ‘my side’.
I know enough about the game to recognize when the other side has been cheating, and have just barely enough faith in our champion to not throw the board and start shooting.

» The Constitutional Importance of the ObamaCare Ruling

…. the left’s incessant attacks against the court and the right as of late — that the conservative Supreme Court has become corrupted by “politicalization” and “activism” — have suddenly become obsolete and exposed as hypocritical. After a slim 5-4 ruling, of the kind leftists typically scorn as illegitimate, The New York Times‘ Ethan Bronner is now opining on the Roberts court’s “balance” and judiciousness. Robert Shrum at the Daily Beast praised the split decision as “clear and compelling,” where before he was anxious to lead the offensive against the “Tea Party Supreme Court” and the “five horsemen of the judicial right.” Much has changed in a single day.
“If no enumerated power authorizes Congress to pass a certain law, that law may not be enacted, even if it would not violate any of the express prohibitions in the Bill of Rights or elsewhere in the Constitution,” Chief Justice Roberts wrote. “The Federal Government has expanded dramatically over the past two centuries, but it still must show that a constitutional grant of power authorizes each of its actions.”

The intent of Congress…. apparently does not matter. Moreover, even though the Chief Justice’s opinion held that Congress did not have the authority under the Commerce Clause to mandate that individuals purchase health insurance, he concluded that Congress nevertheless had the authority to tax individuals for specifically declining to do what Congress had mandated, even though Congress had no authority to impose that mandate in the first place. This simply makes no sense. Chief Justice Roberts went off the rails here to reach the result he wanted to reach and thereby avoid a major blowback against the SupremeCourt’s legitimacy if it had overturned Obamacare.

The conventional wisdom was that Justice Kennedy would be the swing vote in a 5-4 decision and that the individual mandate at minimum would be struck down. The conventional wisdom was wrong. Justice Kennedy voted with the conservative minority in this case. Chief Justice Roberts turned out to be the swing vote, siding with the four liberal Justices to uphold Obamacare even if his reasoning did not fully track with theirs.
What motivated Chief Justice Roberts to become the fifth “liberal” vote in this case? It may seem counterintuitive, but it may have very well been Chief Justice Roberts’ innate conservatism that led him to his surprise decision in this case.

…. Justice Roberts set down markers on the limits of congressional authority under the Commerce Clause and on federalism principles that are now part of one of the most important Supreme Court decisions in decades. They are incorporated into the body of precedents that the Supreme Court in the future will be expected to pay attention to.

Chief Justice Roberts arguably followed a circuitous route to reach the wrong result with regard to the constitutionality of the Obamacare individual mandate. However, whether or not the political process eventually sweeps Obamacare away, the limitations on the Commerce Clause that Chief Justice Roberts used his opinion to clearly articulate will endure and may serve as a brake on future progressive initiatives that go too far.

It appears to me that blocking the future abuse of the Commerce Clause is being considered more strategically important than striking down this particular offensive law.

This court ruling does not mean that we are stuck, forever, with the abomination of Obama’s Hellth Scare. It just means we don’t get the easy way out, we’re gonna have to fight. The law in question can be dealt with, repealed, if We the People do what we must do …. and November may well be our last chance to get it right.

If we fail in November, Obamacare will be the least of our problems.
You may not have a candidate to vote FOR … but you most certainly do have a candidate to vote AGAINST.

You get what you tolerate.

» The Jihadi Threat Within

The FBI’s investigation of over 100 suspected Islamists serving within the US military highlights the growing threat these undercover jihadists pose to American troops, their families and their military communities.
That growing Islamist danger, according to the FBI, comes from an array of active and reserve military personnel as well as individuals who have work or dependent access to military facilities, such as family members and civilian employees.
Moreover, of the 100 investigative cases, the FBI disclosed that a dozen of them are grave enough to be deemed “insider threats,” which it defines as someone planning a terrorist attack on a military base or is in contact with outside individuals who are exhorting them to wage jihad.

Now, the revelation of the FBI’s investigation of the Islamist threat comes as a report on Muslim radicalization by the House Homeland Security Committee has found the danger posed to US military communities both grave and growing, one that has a “potentially devastating development” for the security of troops and their families.
Unfortunately, the House report also noted that the response to this Islamist threat had been undermined by “political correctness” within the United States toward Islam, an attitude which it states has “prevented many from sufficiently acknowledging and tackling this dangerous problem.”

Not surprisingly, one of those unable to adequately grasp the lethal problem posed by these budding jihadists is the Obama administration, which has openly refused to even use the term “Islamic extremists” lest it offend the sensibilities of the broader Muslim world.

“My faith in government is diminished. It invents euphemisms … Little Rock is a drive by and Fort Hood is just workplace violence. The truth is denied.”

At the event that ensued, al-Haddad spelled out, and defended, many aspects of Islamic law, including the death penalty for apostates. Because of this specific statement about executing apostates, al-Haddad was reported to Dutch officials for having broken the same laws that Wilders had been put on trial for violating.

Administration officials intentionally put guns into the hands of Mexican drug cartels, so that when the guns taken from Mexican crime scenes turned out to be American guns, Democrats would have a reason to crack down on gun sellers in the United States.


Democrats will never stop trying to take our guns away.

Why? Ask why. Why do they want the American people disarmed?

…. it’s curious that Democrats all started telling the same lie about guns as soon as Obama became president. In March 2009, Secretary of State Hillary Clinton announced to reporters on a trip to Mexico: “Since we know that the vast majority, 90% of that weaponry (used by Mexican drug cartels), comes from our country, we are going to try to stop it from getting there in the first place.”

As she sentimentally elaborated on Fox News’ Greta Van Susteren show: “The guns sold in the United States, which are illegal in Mexico, get smuggled and shipped across our border and arm these terrible drug-dealing criminals so that they can outgun these poor police officers along the border and elsewhere in Mexico.”

Suddenly that 90% statistic was everywhere.

“Curious” is not the word I would have chosen. If you’re the conspiracy theory type, if you’re looking for a conspiracy to believe in – here it is. I don’t think it’s curious nor coincidental that the entire Dhimmicrat party parroted the 90% fable at the same time (unknown to the public) guns were being walked across the border to fulfill the 90% lie. I believe it was a long-planned and coordinated attack on the 2nd amendment and the rights of Americans.

CBS’ Bob Schieffer asked Obama on “Face the Nation”: “It’s my understanding that 90% of the guns that they’re getting down in Mexico are coming from the United States. We don’t seem to be doing a very good job of cutting off the gun flow. Do you need any kind of legislative help on that front? Have you, for example, thought about asking Congress to reinstate the ban on assault weapons?
At a Senate hearing, Sen. Dianne Feinstein, D-Calif., said: “It is unacceptable to have 90% of the guns that are picked up in Mexico and used to shoot judges, police officers and mayors … come from the United States.”

No one has explained what putting 2,500 untraceable guns in the hands of Mexican drug dealers was supposed to accomplish.

But you know what that might have accomplished? It would make the Democrats’ lie retroactively true — allowing them to push for the same gun restrictions they were planning when they first concocted it. A majority of guns recovered from Mexican criminals would, at last, be American guns, because Eric Holder had put them there.

Unfortunately for the Democrats, some brave whistleblower inside the government leaked details of this monstrous scheme. As soon as Congress and the public demanded answers, Holder clammed up. He just says “oops” — and accuses Republicans of racism.

This is not the first time gunwalking in the Midwest has been reported. Gun Rights Examiner published an exclusive report last September providing documents indicating both ATF and the FBI allowed Indiana “crime gun” sales that, as with much of the reporting done in this column and by Vanderboegh, was ignored by the mainstream press, as has been their normal pattern.

The government of the United States has tried to frame the American gun owner by smuggling weapons into Mexico so the resulting death could be blamed on us.

“We are now taught in an ‘Active Shooter’ course that if we encounter a shooter in a public place we are to ‘run away’ and ‘hide’” union leader Brandon Judd wrote on the website of 3,300-member union local. “If we are cornered by such a shooter we are to (only as a last resort) become ‘aggressive’ and ‘throw things’ at him or her. We are then advised to ‘call law enforcement’ and wait for their arrival (presumably, while more innocent victims are slaughtered).”

This law would require all adults to own a gun or pay a $10,000 fine. They could argue that crime costs everyone, so it isn’t fair for some people to be able to defend themselves and not everyone. The Supremes already said this is a solid argument.

I have to do it today because no power tools are allowed to be used outside on Sunday, and tomorrow I have to get my brand new car, that has 6 miles on it, inspected to see if it is roadworthy. I’ll be doing the speed limit, not talking on my phone, eating, my dog will be restrained in the back seat and I’ll make sure I don’t call the guy who cuts me off a faggot.
